1. About these terms

These Terms of Use govern your access to and use of the Motoring.Today website and services (the “Site”). By accessing or using the Site you agree to these terms. If you do not agree, please do not use the Site.

The Site is operated by AFT Ltd on behalf of Motor Genius Group Ltd (a company registered in England and Wales, company number 15121835; VAT number 476 9784 14) (“we”, “us”, “our”). You can contact us at james@autofintech.co.uk. These terms should be read together with our Privacy Policy, which explains how we handle personal data.

2. Using the Site

You may use the Site for your own lawful, personal, non-commercial purposes of researching, comparing and enquiring about vehicles and finance, and (where applicable) for the legitimate business use of dealer customers under any separate agreement with us. You must be at least 18 to apply for finance or to enter into any transaction facilitated through the Site.

We may update, suspend, restrict or withdraw all or part of the Site at any time. We do not guarantee that the Site, or any content on it, will always be available or uninterrupted.

3. Vehicle information and pricing

Vehicle listings, specifications, images, vehicle history data and prices displayed on the Site are provided by third parties, including our vehicle-data provider, dealers, and official sources such as the DVLA and DVSA (for example tax, MOT and technical vehicle data looked up by registration). We aggregate and present this information, but we do not originate most of it.

While we take reasonable care, we do not warrant that vehicle information, availability, specifications or pricing are accurate, complete or up to date, and this information may change without notice. Any vehicle information on the Site is for general guidance only. Before making any decision or commitment, you must confirm the vehicle’s details, availability, condition and price directly with the selling dealer. We are not party to, and are not responsible for, any sale or contract between you and a dealer.

4. Finance illustrations and our role in finance

Any finance figures, monthly payments, APRs or examples shown on the Site are illustrative examples only. They are not a quotation, an offer of credit, or a promise that finance will be available to you or on the terms shown. Actual terms depend on the lender, the vehicle, and your circumstances. Finance is subject to status and affordability, and to the lender’s checks and approval.

When you choose to apply for finance, we introduce you to our finance partner and, through them, to a panel of lenders. We act as a credit broker, not a lender: we do not lend money and we do not decide whether credit is granted. We are not an independent or whole-of-market broker and do not compare products across the whole market. The credit agreement, if any, is between you and the lender, on the lender’s terms.

We may receive a commission or other payment from our finance partner or a lender when we introduce you to them. The availability or amount of any such commission does not change your eligibility for finance, and you can ask us for more information about how we are paid.

5. No advice

The Site provides information and tools to help you research vehicles and finance. Nothing on the Site constitutes financial, legal, tax or other professional advice, and nothing on it is a personal recommendation that a particular vehicle or finance product is suitable for you. You should obtain your own independent advice where appropriate before entering into any purchase or finance agreement.

6. Dealers, enquiries and third-party content

The Site includes content from, and enables you to enquire with and be connected to, third-party dealers. Dealers are independent third parties; we do not control them and are not responsible for their vehicles, conduct, representations, or the accuracy of the content they supply. Any transaction, negotiation or communication between you and a dealer is solely between you and that dealer.

If you submit an enquiry or use a call-back or click-to-call feature, you authorise us to pass your enquiry to, and to connect you with, the relevant dealer, and you acknowledge that calls may be recorded (see our Privacy Policy).

7. Intellectual property

The Site and its content — including its design, text, graphics, logos, and the compilation and arrangement of listings and data — are owned by us or our licensors and are protected by intellectual property laws. You may view and use the Site for the permitted purposes above, but you may not copy, reproduce, republish, scrape, harvest, redistribute, or create derivative works from the Site or its content, except as expressly permitted by us in writing or as allowed by law. Vehicle and third-party data remain the property of their respective owners.

8. Acceptable use

You agree not to:

• use the Site for any unlawful, fraudulent or harmful purpose;
• use automated means (bots, scrapers, crawlers or similar) to access, copy or extract data from the Site except as we expressly permit;
• attempt to gain unauthorised access to, interfere with, damage or disrupt the Site, its servers, or any connected systems or networks;
• submit false, misleading or unlawful information (including in enquiries or finance journeys), or impersonate any person;
• introduce viruses or other malicious code, or place an unreasonable load on our infrastructure; or
• use the Site or its content to compete with us or to build a competing product or dataset.

We may suspend or terminate your access if you breach these terms.

9. Disclaimers and limitation of liability

The Site and its content are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we exclude all warranties and representations that are not expressly set out in these terms, including as to accuracy, completeness, availability, or fitness for a particular purpose.

To the fullest extent permitted by law, we will not be liable for any loss or damage that is not reasonably foreseeable, or for any indirect or consequential loss, or for loss arising from your reliance on vehicle, pricing or finance information that originates from third parties, or from any dealing between you and a dealer or lender.

Nothing in these terms excludes or limits our liability where it would be unlawful to do so — this includes liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, and for any other liability that cannot be excluded or limited under the law of England and Wales. Nothing in these terms affects your statutory rights as a consumer, and nothing in these terms excludes the rights the Consumer Rights Act 2015 gives you, including our duty to provide any service to you with reasonable care and skill.

10. Third-party links

The Site may contain links to third-party websites and services (for example dealer sites, our finance partner, and mapping providers). We provide these for convenience and do not control or endorse those third parties, and we are not responsible for their content, products, or privacy and terms. Your use of any third-party site is at your own risk and subject to that third party’s terms.

11. Changes to these terms

We may amend these terms from time to time. The current version will always be posted on the Site with the “Last updated” date. Your continued use of the Site after changes take effect means you accept the amended terms.

12. Governing law and jurisdiction

These terms, and any dispute or claim arising out of or in connection with them or your use of the Site (including non-contractual disputes or claims), are governed by the law of England and Wales. The courts of England and Wales will have exclusive jurisdiction, except that if you are a consumer resident elsewhere in the UK you may also bring proceedings in your home jurisdiction.
